This is the wholly misconceived petition filed by the petitioner seeking for a direction in the nature of mandamus commanding the respondent to take work as Permanent Clerk from him as he is senior and has completed 34 years of service. As per the statement in the writ petition, the petitioner was appointed on 01.02.1985 (as a muster roll employee) as Clerk-cum-Typist in the Department of Jal Nigam, Rakhrakhav Branch, Agra.
In continuation of his temporary services he was regularized on 01.04.1990. It is contended that since after regularization, the petitioner is discharging the duties of typist and the work of clerk has never been assigned to him. It is further contended that the petitioner being senior is entitled for getting the duties of a Permanent Clerk.
This submission of the petitioner is found misconceived for the reason that the petitioner has been appointed on the post of Clerk-cum-Typist and the work of typist which is being taken from him is in accord with the duties and responsibilities attached to the post held by him.
