Heard Sri Manoj Kumar Singh, learned counsel for the petitioner, Sri Harsh Dwivedi, learned counsel holding brief of Sri Abhishek Mishra for the respondent no.2 and the learned standing counsel for the respondents no. 1, 3, 4 and 5.
The petitioner in the writ petition is seeking a direction to the respondents for payment of gratuity, leave encashment, arrears and other consequential benefits of service in terms of 6th pay commission. The petitioner is stated to have retired from service on 31.3.2012.
No useful purpose would be served in keeping the petition pending.
This writ petition is disposed of with a direction that if the petitioner prefers a fresh representation before the respondent no.4-Join Registrar/Joint Commissioner, Cooperative Society Moradabad Division, Moradabad within 15 days from today along with the certified copy of this order raising all his grievances as raised in the present petition, the respondent no.4 shall consider and decide the same in accordance with law within a period of three months thereafter.
It is made clear that the court has not adjudicated the claim of the petitioner on merit.
