On oral request of learned counsel for the petitioners, in view of the nature of controversy, Poonam Singh D/o Bahadur Singh R/o Village Bihara, P.S. Mawai, District Faizabad, is directed to be impleaded as respondent no.3.
Learned counsel for the petitioners contends that it is evident from the statement of added respondent no.3 recorded under Section 164 Cr.P.C. (Annexure 4) that no offence under Section 363, 366 or 376 I.P.C. has been committed and yet the petitioners are being proceeded against.
It has been asserted that Poonam eloped with petitioner no.1 of her own accord and had physical relations with him. The two got married.
Issue notice to Respondent No.3 for 04.7.2012.
Let Satish Kumar Gupta and respondet no.3 remain present in court on the next date of listing.
