Heard Sri M. A. Mishra, learned counsel for the petitioner and Sri R. P. Dubey, learned Additional Chief Standing Counsel.
The petitioner has preferred the present writ petition with the following prayer :-
"(i) Issue a writ order or direction in the nature of writ of mandamus commanding and directing the respondents to pay the salary of the petitioner from 11.10.2018 (as the post was vacant and the respondent no.2 permitted the petitioner to work on vacant post of assistant clerk).
(ii) Issue a writ, order or direction in the nature of mandamus commanding the respondent no.2 to decide the representation dated 01.01.2019 of the petitioner (Annexure No.15 to this writ petition) within stipulated period."
A preliminary objection has been raised by Sri R. P. Dubey, learned Additional Chief Standing Counsel that the petitioner has earlier filed a writ petition being Writ A No.6502 of 2019 (Satish Chandra Yadav Vs. State of U.P. and 2 others). The said writ petition was dismissed on 25.4.2019.
In view of the aforesaid arguments, a request was made by the learned counsel for the petitioner for the dismissal of the writ petition.
This prayer was not opposed by Sri R. P. Dubey, learned Additional Chief Standing Counsel.
