Heard learned counsel for the petitioner and Shri Manu Singh for the Gaon Sabha.
This writ petition has been filed seeking the following relief:-
"(1) issue a writ, order or direction in the nature of mandamus directing the concerned court i.e. Sub Divisional Magistrate Sadabad, Hathras/respondent no. 1 to decide the suit no. 23 of 2016 (Satish Chandra versus Mahesh Chand and another) Under Section 116 UP Revenue Code 2006 Mauja Baghena Tehsil Sadabad District Hathras within the stipulated time as is fixed by this Hon'ble Court."
It has been submitted that the suit for partition filed in the year 2016 has not been decided finally till date.
However, counsel for the petitioner admits that till date, although written statement has been filed, issues have not yet been framed in the suit.
Under the circumstances, this writ petition is disposed of with a direction to the respondent no. 1 to decide the case as expeditiously as possible, preferably within a period of one year from the date a certified copy of this order is filed before him.
