This writ petition is filed challenging the impugned order dated 21.1.2021 whereby the fair price shop of petitioner was suspended.
Learned counsel for petitioner has filed the supplementary affidavit on 21.6.2021 wherein the order dated 8.6.2021 is annexed whereby the Sub-Divisional Officer, Iglas, District - Aligarh has cancelled the agreement/contract of petitioner's fair price shop. Therefore, the prayers in this writ petition has rendered infructuous.
However, learned counsel for petitioner is at liberty to challenge the above referred order dated 8.6.2021 in the alternative remedy available to him under Section 13 of the U.P. Essentials Commodities (Regulation of Sale and Distribution Control) Order, 2016.
In view of the above, the writ petition is finally disposed of with the direction that Competent Authority while dealing with the appeal of petitioner, a period wherein this writ petition was pending before this Court, may be considered.
