Heard learned counsel for the petitioner, learned standing counsel for the state-respondents and Sri R.P. Singh, learned counsel for the respondent nos. 2 and 3.
This writ petition has been filed for the following relief:
"Issue a writ, order or direction in the nature of mandamus, directing the respondent No.2 and 3 to pay the current pension, arrears of pension, arrears of selection grade salary and other post retiral dues to the petitioner along with interest @ 18% within stipulated period as specified by this Hon'ble Court."
It is the case of the petitioner that he retired on 2.3.2018 from the post of Headmaster in the respondent no.4 institution, yet his current pension and arrears of grade salary and other post retiral dues have not been paid to him by the respondent nos. 2 and 3.
Learned counsel for the respondent nos. 2 and 3 submits that the petitioner may make a representation before the respondent no. 2 raising all his grievances which shall be considered by the respondent no.2 and an appropriate order, in accordance with law, shall be passed within a time bound period.
In view of the aforesaid, this writ petition is disposed of giving liberty to the petitioner to make a representation before the respondent no.2 within three weeks' from today alongwith a certified copy of this order, raising his grievances. In the event, such a representation is made within the stipulated period, the respondent no.2 shall decide it in accordance with law, expeditiously, preferably within next six weeks.
If the respondent no.2 finds that any amount is legally due and payable to the petitioner, he shall ensure that it is paid to the petitioner within next six weeks.
