Heard learned counsel for the applicant and learned A.G.A on behalf of the State.
This application under Section 482, Cr.P.C. has been filed for a direction to the court of Chief Judicial Magistrate Bulandshahar to decide the Complaint Case No.3102 of 2014 (Satish vs. Ex-Additional Chief Officer and others) under Sections 420, 467, 468, 471, 417 and 469 I.P.C, Police Station Sikandrabad, District Bulandshahar within time bound period.
It is submitted by the learned counsel for the applicant that he is complainant and had filed a complaint on 02.09.2014 before the Court of Chief Judicial Magistrate, Bulandshahar against the opposite party nos.2 to 24 registered as Case No.3102 of 2014. It is next contended by the learned counsel for the applicant that the aforesaid case of the applicant is pending since 02.09.2014 and no effective proceeding in the matter is going on. In support of his contention certified copy of the order sheet of the case has been filed as Annexure 2 with the application.
It is also submitted that statement under sections 200 and 202 Cr.P.C. had already been recorded in the year 2014 itself but till date even no order under section 204 Cr.P.C. has been passed.
In view of above, looking into the facts and circumstances of the case, Chief Judicial Magistrate, Bulandshahar is directed to proceed with the trial effectively and conclude the same within a period of six months from the date of production of certified copy of this order, without granting any unnecessary adjournment to the parties concerned.
With this observation the application under section 482 Cr.P.C. is disposed of.
