The order impugned does not suffer from any error of jurisdiction warranting interference under Article 227 of the Constitution of India. The petitioner is free to put in an application afresh for obtaining certified copy of the judgment.
2. I make it clear that a decree is not necessary for filing an appeal as per the amended provisions of Order XLI of the Code of Civil Procedure. The petitioner can also apply for condonation of delay in filing the appeal stating the preferment of an earlier copy application.
The Original Petition is dismissed subject to the above clarification.
