Yoganna, HCGP) This Criminal Petition is filed under Section 439 of the Cr.P.C., praying to enlarge the petitioner on bail in Cr. No.150/2018 registered by Puttenahalli Police Station, Bengaluru for the offences p/u/s 302, 201, 316 and 498(A) of IPC.
This Criminal Petition coming on for orders this day, the Court, made the following:
ORDER The petitioner files a memo seeking to withdraw the petition.
2. The petitioner states that request for bail in C.Misc.No.9624/2018 was rejected by the Trial Court at the stage when the investigation was in progress. It is further submitted that the charge sheet has been filed and investigation is complete and the matter has been committed for trial to the Court of Sessions. The petitioner states that he would withdraw the petition reserving liberty to move the Sessions Court as the matter is now committed to the Court of Sessions.
3. Taking note of the fact that charge sheet has been filed, right of the petitioner to move petition for bail before the Sessions Court is always available in the light of subsequent filing of the charge sheet, which was subsequent to the order passed by the Sessions Court, i.e., 4.12.2018.
4. Accordingly, the petition is dismissed as withdrawn with liberty to approach the Trial Court.
