It is seen from the pleadings and proceedings that the petitioner had earlier approached this Court by filing W.P.(C) No. 9483 of 2013, challenging the course and proceedings pursued by the respondent Bank invoking the machinery under the SARFAESI Act for realization of the amount under loan transaction. As per Ext. P1, the petitioner was permitted to liquidate the liability by way 'ten' equal monthly installments starting from 01.07.2014. Admittedly, the petitioner did not honour the commitment. Since the matter has become final by virtue of Ext. P1 judgment, the prayer of the writ petitioner to have further indulgence of this Court cannot be entertained. There is no sustainable grounds as well. The Writ Petition fails and the same is dismissed accordingly.
