The petitioner has approached this Court challenging the final order passed by the District Registrar, Palakkad as per Ext.P1 under Section 45 B of the Kerala Stamp Act. According to the petitioner, the actual consideration was set out in the instrument and there is no violation of stamp duty.
The petitioner has alternate remedy before the District Court against Ext.P1. Therefore, the petitioner shall approach the District Court, Palakkad under Section 45 (4) of the Stamp Act. In order to work out the petitioner's alternate remedy, all proceedings pursuant to Ext.P1 will stand stayed for a period of four weeks.
The writ petition is disposed of as above.
