The defendants in O.S.No.7 of 2003 on the file of the Court of the Subordinate Judge, Manjeri are the appellants in this appeal. The suit O.S. No.7 of 2003 was one for realisation of money. As per the decree and judgment impugned in this appeal, the respondent was permitted to recover a sum of Rs.5,67,000/- from the appellants with interest and costs.
2. The plaintiff in the suit has preferred a cross objection challenging the decree and judgment to the extent it decided against him.
3. In the course of the proceedings, the parties were referred for mediation and the matter has been settled at the mediation. The memorandum of settlement arrived at between the parties at the mediation is part of the records. We have perused the terms of settlement and we are satisfied that the terms of settlement are lawful.

4. In the circumstances, the judgment and decree impugned in this appeal are set aside and the appeal and the cross objection are disposed of in terms of the settlement. In view of Section 69A of the Kerala Court Fees and Suits Valuation Act, the court fee paid on the appeal and the cross objection shall be refunded to the respective parties. A copy of the memorandum of settlement shall be appended to this judgment and the original shall be preserved.
