JUDGMENT / ORDER

Petitioner is the fifth accused in Crime No. 96/2014 of Shornur Police Station for the offences punishable under Sections 341, 326, 120 (B), 201, 212 and 307 read with Section 34 of the Indian Penal Code, is in custody from 05.05.2014 and seeks bail. 2. It is submitted that on 31.01.2014 at about 12.15 p.m, the petitioner while driving a car hit the motor cycle which the de facto complainant was riding. The de facto complainant fell down. Thereon, as part of the criminal conspiracy accused 1 to 4 chased him and assaulted with sword.
3. Heard the learned counsel for the petitioner also.
4. It is seen that accused 12 and 13 in the case are granted bail by this Court as per order dated 11.04.2014 in B.A. No. 2586/2014. Learned counsel submits that some of the other accused are also released on bail. In the light of the above, I am inclined to grant relief to the petitioner.
Application is allowed as under:
Petitioner is granted bail in Crime No.96 of 2014 of the Shornur Police station and shall be released on bail ( if not required to be detained otherwise) on his executing bond for Rs.25,000/- (Rupees Twenty five thousand only) with two sureties for the like sum each to the satisfaction of the learned magistrate and subject to the following conditions:
(a) One of the sureties shall be a close relative of the petitioner.
(b) Petitioner shall report to the investigating officer on every Saturday between 10.00 am and 12.00 pm until filing of the final report.
(c) Petitioner shall report to the investigating officer as and when required for interrogation.
(d) Petitioner shall not get involved any offence during the period of this bail.
(e) Petitioner shall not intimidate or influence the witnesses.
(f) In case any of condition nos.(b) to (e) is violated, it is open to the investigating officer to file application before the learned magistrate (until committal of the case if any, and thereafter before the learned Principal Sessions Judge concerned) for cancellation of the bail granted hereby, as held in P.K. Shaji V. State of Kerala (AIR 2006 SC 100).
