The petitioners who are members of the teaching faculty of the S.V.R.N.S.S College at Vazhoor in Kottayam district approached this Court through the present writ petition, seeking a direction to the respondents to deduct Income tax from the arrears of DA/DP payable to the petitioners and, thereafter, to remit the balance amount to the general provident fund account of the petitioners. It is seen that, by an interim order dated 24.09.2008, this Court had directed the respondents to deduct income Tax payable from the DA arrears of the petitioners and to credit the balance amount to the provident fund account provisionally. It was also directed that the amount recovered towards payment of income tax would be made over to the Income Tax Department and that the said arrangement was to be subject to the result of the writ petition. The interim order passed by this Court virtually granted the petitioners the main relief that they were seeking in the writ petition, and in that view of the matter, nothing survives to be considered in the writ petition. Any amount that has been paid to the Income Tax Department by way of tax deducted from the W.P.(C).No.27901 of 2008 2 amounts payable to the petitioners towards arrears of DA/DP, would necessarily stand to the credit of the petitioners and considered in their individual assessments under the Income Tax Act. The petitioners will not, therefore, be prejudiced in any manner by the deduction so made pursuant to the interim direction of this Court. As there are no further reliefs sought for in the writ petition, the writ petition is closed based on the interim orders already passed by this Court.
