Heard Sri Chandra Prakash Pandey, learned counsel for the applicant and learned A.G.A. for the State.
At the very outset learned counsel for the applicant has requested for some protection at the stage of bail.
So far as merit of application is concerned the applicants have been summoned by the C.J.M., Kannauj by order dated 20.10.2018 in a case initiated on the basis of F.I.R. in which after investigation the police filed final report and notice was sent to the informant, he filed a protest application and the same was processed as complaint case and after taking evidence, the learned C.J.M. found prima facie case against the applicants for the offence under section 302, 120B I.P.C. and summoned them. Against that order, the applicants filed a revision before the Sessions Judge as Criminal Revision No. 3 of 2019 and the same was rejected by the Sessions Judge by order dated 15.05.2019.
It means that there is concurrent finding of both the court below, therefore, there appears to be no ground in which the authority under section 482 Cr.P.C. can be invoked.
Therefore, the application under section 482 Cr.P.C. is finally disposed of with the observation that from today if within 60 days, the applicants appear and file bail application, the same shall be disposed of expeditiously in accordance with law preferably on the same day.
For these 60 days no coercive measures shall be taken but in no case this period of 60 days shall be extended.
