Heard learned counsel for the applicant as well as learned A.G.A.
The instant application is being moved by the applicant invoking the powers of Section 438 Cr.P.C. apprehending his arrest in connection with Case Crime no.0040 of 2020, under Section 498A, 323, 504, 506 I.P.C. and Section 3/4 of D.P. Act, Police Station-Pallavpuram, District-Meerut.
A perusal of the material available on record shows that the applicant approached this Court challenging the charge sheet by filing Application U/S 482 Cr.P.C. No.14924 of 2020 and this Court, vide order dated 07.10.2020, granted an opportunity to the applicant which reads thus :-
"For a period of two months from today or till the applicant nos.1&3 surrenders and applies for bail whichever is earlier, no coercive action shall be taken against them. However, in case, they do not appear before the Court below within the aforesaid period, coercive action shall be taken against them."
It seems that the applicant is running from the court of law, hence, I am not inclined to exercise my power in favour of the applicant under section 438 Cr.P.C.
Accordingly, the present anticipatory bail application stands REJECTED.
