This anticipatory bail application u/s 438 Cr.P.C. has been moved seeking the bail of applicant namely Satendra Kumar Singh, in the event of his arrest in Case Crime No.210 of 2019, under Sections 63 and 63 of U.P. Excise Act, Police Station Awagarh, District Etah.
Heard learned counsel for the applicant and learned A.G.A. for the State and perused the record.
It appears that the applicant is said to be the owner of container from which 900 boxes of illicit contraband liqueur were recovered. The recovery of contraband liqueur is huge which cannot be said to be planted by the police. Illicit transport of contraband liqueur on such large scale is an egregious crime and has often resulted into massive loss of life.
After considering the submissions advanced on behalf of rival sides, the nature and gravity of the accusation and the material in support of the same, I find no good ground for grant of anticipatory bail to the applicant.
Accordingly, the anticipatory bail application is rejected.
It is clarified that the observations, if any, made in this order are strictly confined to the disposal of the bail application and must not be construed to have any reflection on the ultimate merits of the case.
