Heard the learned counsel for the applicants and the learned AGA and perused the record.
A preliminary objection was raised on behalf of the State that earlier a petition was filed by the applicants which was dismissed and even then paragraph 2 of this application is disclosing that this is the first criminal misc. application under section 482 Cr.P.C. Though the learned counsel for the applicants submitted that paragraph 21 of this application has been added to verify that earlier an application no. 21343 of 2010 has been dismissed with a liberty to file a fresh application.
Again the learned AGA raised objection that it is not clear as to whether in the earlier application both the applicants were arrayed as party nor not.
I do find it expedient that the earlier criminal misc. application no. 21343 of 2010 be summoned.
Put up after lunch along with earlier record of the criminal misc. application no. 21343 of 2010.
