Sasikumar M A vs State Of Kerala

High Court Of Kerala|16 December, 2014

JUDGMENT / ORDER

The petitioner has filed this writ petition seeking the following reliefs :
i) Issue a writ of mandamus or any writ order or direction directing the Tribunal for Local Self Government to dispose of Exhibit-P7 petition without any delay irrespective of Exhibit P5 judgment.
ii) To declare the 3rd & 4th respondents are not entitled to execute any work in pursuance of Exhibit P3 and P4 proceedings, and pending order in Exhibit P7 petition.
The petitioner has submitted Ext.P7, which according to him is a petition seeking an interim order of stay from the Tribunal for Local Self Government Institutions, Thiruvananthapuram. The said petition is dated 08.12.2014. The complaint of the petitioner is that, the Tribunal has not passed any orders thereon till date. The petition has been filed only a week back.
2. It is not clear whether the petitioner has moved the Tribunal seeking an interim order of stay. Since the petitioner has already filed Ext.P7 petition seeking interim orders from the Tribunal, it is for the petitioner to pursue the same before the Tribunal. It cannot be said that the petition has been pending for an abnormally long period of time warranting the issue of any direction by this Court. If the petitioner requires orders urgently, it shall be open to the petitioner to W.P.(C) No.34030 of 2014 2 represent the matter before the Tribunal and to move the petition urgently.
I do not find any grounds to entertain this writ petition or to grant any of the reliefs sought for. This writ petition is, therefore, dismissed.
