JUDGMENT / ORDER

The petition is filed under Section 439(1) Cr.P.C. read with Section 41A of the Abkari Act.
2. Petitioner is the accused No. 2 in Crime No.317 of 2014 of Noornadu Police Station registered for the offences under Sections 8, 55 (a) (i) and (g) of the Abkari Act.
3. The prosecution case is that on 8.3.2014 the petitioner along with the first accused was found manufacturing arrack. 700 ml of arrack was seized from them. The learned counsel for the petitioner submits that the petitioner has been in custody since 8.3.2014 and there is no evidence to prove the prosecution allegation.
4. Heard both sides.
5. The petition is opposed by the learned Public Prosecutor.
The offences alleged to have been committed by the petitioner are very serious. Prima faice, there is an evidence to prove the commission of offences by him. I am not satisfied that there are B.A. No. 2971 of 2014 -2-
reasonable grounds for believing that the petitioner is not guilty of the offences or that he is not likely to commit any offence under the Abkari Act while on bail. He cannot be released on bail at this stage.
In the result, this application is dismissed.
