Heard learned counsel for the petitioners as well as learned Additional Government Advocate and perused the record.
The petition under Section 482 Cr.P.C. seeks quashing of the proceedings of Case No.1453 of 2020, arising out of Case Crime No.259 of 2019, under Sections 323, 504, 506, 452 IPC and Section 3(1) Da, Dha SC/ST Act, Police Station Nagram, District Lucknow, pending in the Court of Special Judge (ASJ) SC/ST Act, Lucknow.
After hearing the submissions and perusing the record, I find no ground to interfere with the ongoing proceedings.
At this stage, learned counsel for the petitioners has submitted that the petitioner may be given some time to apply for bail.
Considering the aforesaid, this petition is disposed of with the direction that in case the petitioners appear/surrender before the court below within 10 days from today and apply for bail, the same shall be considered and decided in view of the settled law laid down by this Court in Amrawati and another Vs. State of U.P. reported in 2004 (57) ALR 290 as well as by the Supreme Court in Lal Kamlendra Pratap Singh Vs. State of U.P., 2009 (3) ADJ 322 (SC). For a period of 10 days from today, no coercive measure to be taken against the petitioner/s.
