Heard learned counsel for the applicant and learned AGA for the State.
300 gms. charas is said to have been recovered from the applicant's possession on 14.10.2009, which is below commercial quantity.
The submission made by learned counsel is that no such incident as alleged in the FIR had occurred and the applicant has been falsely roped in this case by the police.
Further submission made by learned counsel is that compliance of certain sections of NDPS Act was not made by the police at the time of alleged recovery.
Having considered the submissions made by the learned counsel and keeping in view all the facts and circumstances of the case, but without expressing any opinion about merit, the applicant may be released on bail.
Let the applicant Sarwan Babu s/o Tulsiram be released on bail in case crime 1975 of 2009 under section 18/20 NDPS Act, P.S. Sungarhi, District Pilibhit on his executing a personal bond of Rs. 30,000/- and furnishing two sureties each in the like amount to the satisfaction of the court concerned.
