Heard Sri Yashpal Yadav, learned counsel for the petitioners, Sri Anurag Singh, learned counsel for the respondent no.4 and Sri G.P. Singh, learned AGA for the State and perused the record.
The relief sought in this petition is for quashing of the F.I.R. dated 2.3.2018, registered as case crime no.63 of 2018, u/s 147, 436, 504, 506 IPC and u/s 3(2)(v) SC/ST Act, P.S. Jansa, district Varanasi.
Learned counsel for the petitioners submits that petitioners and respondent no.4 are resident of same village. They have compromised the dispute outside the Court and executed an affidavit before the S.S.P, Varanasi on 28.5.2018.
Learned counsel for the respondent no.4 has admitted the fact of compromise entered into between the parties and he has no grievance if the present FIR is quashed by this Court.
Considering the submissions made by learned counsel for the parties, we do not find any ground to interfere in the matter. However, the Investigating Officer of the case is directed to look into the compromise entered into between the parties, who shall submit police report before the competent court in accordance with law within one month from today.
It is further directed that the petitioners shall not be arrested in above mentioned case, till submission of the police report under section 173(2) Cr.P.C.
The S.S.P. Varanasi shall ensure that Investigating Officer concerned submits proper police report before the competent court.
With the aforesaid directions, this writ petition is finally disposed of.
