Heard learned counsel for the parties.
In compliance of the order of this Court dated 01.09.2021, learned Standing Counsel Sri Rohit Verma has obtained instruction in the matter and as per the instruction, the pending restoration application of the applicant under Order IX Rule 4 for recall of the order of the dismissal of suit for non prosecution has come to be allowed on 20.09.2021.
Copy of the instruction is supplied to learned counsel for the applicant and the same is also placed on record.
In view of the above, since restoration application of the applicant has come to be allowed, the order of writ Court has stood complied with. Now there remains nothing to continue with this contempt application.
Contempt application is accordingly consigned to record. Notices issued, if any, stand discharged.
