Heard Sri Sanjeev Kumar Sharma, learned counsel for the petitioner, Sri N.K. Verma, learned A.G.A. for the State and perused the impugned F.I.R. as well as material brought on record.
The relief sought in this petition is for quashing the impugned F.I.R. dated 18.05.2018, registered as Case Crime no. 127 of 2018 under section 409 I.P.C., P.S. Ahraura, District Mirzapur.
Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in the present case with malafide intention. He further submitted that the allegations levelled against the petitioner are absolutely false, frivolous and baseless. No offence is made out against the petitioner, hence, F.I.R. is liable to be quashed.
Learned A.G.A. opposed the prayer for quashing of the F.I.R. and states that a Criminal Misc. Writ Petition No.13796 of 2018, filed by co-accused, has been rejected by this Court on 28.05.2018.
In view the aforesaid fact that a Criminal Misc. Writ Petition filed by co-accused has already been rejected by this Court, hence, this Writ Petition is, accordingly, dismissed.
