Petitioner is a retired Junior Engineer, who has approached this Court for a direction upon the respondents to release petitioner's pension and withheld 10% GPF amount. Contention is that after petitioner's superannuation on 31st August, 2016, nearly two years are about to expire, but the aforesaid amounts have not been released. It is also stated that there is no justifiable reason for withholding such benefit.
Learned Standing Counsel submits that the grievance of petitioner, in that regard, shall be examined by the competent authority, in accordance with law.
In the facts and circumstances, this writ petition stands disposed of with a direction upon respondent no.2 to ensure release of pension and balance 10% GPF amount, in accordance with law, within a period of four months from the date of presentation of certified copy of this order. In case the amount is not released by then, petitioner shall be entitled to interest at the rate of 8% per annum. It shall, however, be open for the respondents, in such eventuality, to determine the guilt of the person, who is responsible for not releasing the aforesaid amount and to recover such amount from the salary of the erring officer, in accordance with law.
