Heard learned counsel for the petitioner and Sri Satish Chaturvedi, learned counsel for the respondent Bank.
Learned counsel for the petitioner submits that the petitioner has taken a loan for Rs.3 Lacs in the year 2006 for agricultural purpose and he is ready and willing to deposit the entire amount within time fixed by the Court.
With the consent of learned counsel for the parties, the petition is disposed of finally by passing the following directions:-
(i) The petitioner undertakes to deposit a sum of Rs.1 lac on or before 31st August, 2018 as first instalment.
(ii) The second installment of Rs.50,000/- will be deposited on or before 15th October, 2018.
(iii) The respondent Bank will provide a complete statement of accounts to the petitioner within a week from the date of second installment is paid and the petitioner thereafter will pay the entire outstanding amount, so as indicated in the statement of accounts, by 30th November, 2018.
In default of any above conditions, this order automatically stands vacated.
If the petitioner complies with the aforesaid conditions, no coercive action shall be taken against the petitioner for recovery of the said amount.
No recovery charges shall be recovered from the petitioner, if the petitioner complies the above conditions.
With the directions above, the writ petition is finally disposed of.
