Heard learned counsel for the parties.
Petitioner was working as head constable, he came to be promoted on the post of Sub-Inspector, consequently, petitioner has been transferred from District Agra to District Aligarh.
It is urged that more than six months have lapsed, however, the petitioner is retaining the official accommodation at Agra. By the impugned order dated 31 March 2019, petitioner has been directed to surrender the official accommodation.
It appears that earlier petitioner had approached this Court by filing a petition being Writ-A No. 2345 of 2019 which came to be disposed of on 14 February 2019.
On specific query, learned counsel for the petitioner is unable to show any Rule, Order/Circular entitling the officer to retain official accommodation after transfer. Further, he is unable to point out any illegality, infirmity or jurisdictional error in the impugned order.
The writ petition being devoid of merit is accordingly dismissed.
