The sole grievance which is addressed in this petition is of the respondent having refused to send the petitioner for training consequent to his selection on the post of Constable. The aforesaid action appears to be based on the arraignment of the petitioner in a criminal case bearing Case Crime No.0588 of 2017. Admittedly the petitioner is named in the chargesheet which was submitted in respect of the aforesaid case crime on 24 December 2017. The submission however is that the petitioner had made a frank and candid disclosure in respect of that case in the affidavit and the form which was submitted. It is in the aforesaid backdrop that Sri Gautum, learned Senior Counsel contends that the candidature of the petitioner is liable to be processed further bearing in mind the decision of the Supreme Court in Avtar Singh Vs. Union of India [(2016) 8 SCC 471].
Sri Birendra Pratap Singh, learned Standing Counsel, appearing for the respondent no.7 states that subject to verification of all facts and contentions on merits being kept open, the grievance of the petitioner as noted above, shall be duly examined in accordance with law and a reasoned decision in respect thereof communicated with expedition and preferably within a period of three months from the date of presentation of a duly authenticated copy of this order.
Accordingly, this petition shall stand disposed of in light of the statement noted above.
