Heard learned counsel for the petitioner and learned Standing Counsel appearing for State-respondents and perused the record. Sri Manoj Kumar Yadav, learned Standing Counsel has accepted notice on behalf of respondent no.5, Gaon Sabha.
Present petition has been filed with a prayer that respondents be directed to conclude the enquiry against the Pradhan, respondent no.5 under U.P. Panchayat Raj (Removal of Pradhan, Up-pradhan & Members) Enquiry Rules, 1997 in pursuance to the letter dated 13.07.2018 issued by District Panchayat Raj Office, Jaunpur, within stipulated period.
Drawing attention to annexure-2 to the petition, submission of learned counsel for the petitioner is that on the complaint of the petitioner preliminary enquiry was conducted and enquiry officer submitted his report dated 20.7.2018 and thereafter as per sub clause (2) of Rule 4 of Rules, 1997 Enquiry Committee was constituted to conduct the enquiry vide letter dated 13.7.2018 but till date no enquiry has been conducted.
In such view of the matter, present petition stands disposed of with a direction to respondents to conclude the enquiry as per Rule 4 of the U.P. Panchayat Raj (Removal of Pradhan, Up-pradhan & Members) Enquiry Rules, 1997 within the time provided under sub-Rule 2.
