Hon'ble Saral Srivastava,J.
On instructions, Sri Dalvir Singh, learned Standing Counsel states that the petitioner has been wrongly allotted shop in question inasmuch as he is not the resident of village Dhakiya Sahadat Ali, Tehsil Nawabganj, District Bareilly. He submits that enquiry was conducted in which it was found that the petitioner is not resident of the said village and, therefore, the shop has been wrongly allotted to the petitioner.
Be that as it may, the license granted to the petitioner has not yet been cancelled. The petitioner has been allotted shop in question and is entitled for release of quota card. In the facts of the present case, the petitioner may submit a representation to the Sub Divisional Magistrate, Tehsil Nawabganj, District Bareilly alongwith all documents indicating that he is resident of village Dhakiya Sahadat Ali, Tehsil Nawabganj, District Bareilly within three weeks from today, who shall consider the same after giving due opportunity of hearing to the petitioner and pass a reasoned & speaking order within two months thereafter.
It is needless to say that if the claim of the petitioner is found to be genuine and correct, the authority shall issue the quota card to the petitioner.
The writ petition is disposed off.
