After some arguments it is argued by Sri Rahul Saxena, counsel for the petitioners that he does not want to press present petition with liberty to file a misc. appeal against the order dated 28.1.2019 passed by the Civil Judge (S.D.), Bareilly in Original Suit No.278 of 2018 (Sarvesh Kumar Vs. Satish Kumar and others).
Without entering into merits of the case, present petition is dismissed permitting the petitioner to file a misc. appeal, if so advised, in accordance with law.
