Heard learned counsel for the petitioner and Gyanesh Kumar Mishra holding brief of Sri K.M.Asthana, learned counsel for the respondent bank.
The petitioner has prayed for quashing of the notice dated 16.05.2018 whereby the petitioner has been called upon to repay the outstanding dues or else the vehicle shall be auctioned and put to sale. The petitioner contends that he is prepared to negotiate with the bank and clear off all current outstanding installments as on date. It is open to the petitioner to tender any such offer to the respondent no.2 bank who may consider the same in accordance with law but so far as the proceedings are concerned we do not find any such error so as to quash the demand notice and entertain a writ petition on that count. The writ petition stands disposed of without prejudice to the rights of the petitioner to approach the bank.
