Heard Sri Dinesh Kumar Tripathi, learned counsel for the petitioner and Sri Shishir Jain, learned counsel for the opposite parties.
Sri Shishir Jain, learned counsel for the opposite parties has filed counter affidavit on 21.05.2015 wherein he has categorically taken the grounds of maintainability of the writ petition submitting that the petitioner had earlier filed the writ petition and pursuant to the order of the earlier writ petition, order has been passed by the authority concerned and the said order was not challenged by the petitioner, and that fact has not been disclosed. The specific paragraphs to that effect are paragraphs-8, 9 & 10 of the counter affidavit.
By means of rejoinder affidavit, the petitioner replied to the contents of paras-8, 9 & 10 of the counter affidavit, vide paras-8 & 9 of the rejoinder affidavit but the specific and categorical reply of paras-8,9 & 10 has not been given.
Therefore in view of the above, learned counsel for the petitioner prays for and is granted ten days' time to file specific reply to the contents of paras-8, 9 & 10 of the counter affidavit so that the grounds of maintainability of the writ petition can be dealt with.
