Heard learned counsel for the petitioner and the learned Standing Counsel appearing for the respondents.
This writ petition has been filed seeking a direction to the respondent authorities to enquire into the matter and to get measurement made through Area Lekhpal on the spot in respect of petitioner's 1/3rd share i.e. 0.1017 hectare land of Arazi Gata no. 705 total area 0.3050 hectare situated in village Barahat, Pargana Tappa Bazar, Tehsil Bindki, district Fatehpur and fix the boundaries in accordance with law and also to consider the claim of the petitioner and take appropriate decision upon her application dated 5.9.2018 filed as Annexure-4 to the writ petition forthwith in accordance with law within a reasonable time by a reasoned and speaking order.
Considering the facts and circumstances of this case, without expressing any opinion on the merits of the case, the respondent no. 3, the Up Ziladhikari, Bindki, District Fatehpur is directed to decide the aforesaid matter, as expeditiously as possible, preferably within three months, in accordance with law, without granting any unnecessary adjournments and giving short dates provided there is no other legal impediment.
A reference may also be made to the judgments of this Court in the cases of Chandra Bali vs. Additional Commissioner and others, 2012 (4) ADJ 13 and Radha Devi vs. State of U.P. and others, 2016 (6) ADJ 753 wherein directions for time bound disposal of such cases have been given and provisions of U.P. Janhit Guarantee Adhiniyam, 2011 have been considered.
With the aforesaid observations, present writ petition stands disposed of.
