This writ petition has been filed challenging the order dated 13.12.2013 passed by Assistant Collector/District Deputy Director of Consolidation, Unnao.
The grievance of the petitioner primarily is by the order impugned the opposite party no.1 has been granted liberty to file a fresh objection. It is the case of the petitioner that objections have already been filed prior to 1993 and they have also been decided. Therefore, there is no justification for the Deputy Director of Consolidation to have directed the Consolidation officer to invite fresh objections from the parties and the dispute should be decided on the basis of the objection already filed.
Having considered the submissions raised by the learned counsel for the petitioner, I am not inclined to interfere in the writ petition at this stage. It is however provided that the petitioner may raise this plea before the Consolidation Officer who while deciding the objections that have been filed or may be filed, shall also consider and decide the plea of the petitioner.
The writ petition is accordingly disposed with the aforesaid observations.
