Counter and rejoinder affidavits are taken on record.
Ms. Afreen Bano, who has been identified by Mr. Akhter Abbas, learned counsel appearing on behalf of the petitioners and Mr. Narendra Gupta, learned counsel for the respondents, has been produced by the police before the Court.
Ms. Afreen Bano made a statement before the Court that she entered into wedlock with Shri Sartaj (petitioner No.1). Admittedly, according to High School certificate, her date of birth is 20.4.1992. Accordingly, she has attained the age of majority at present time.
It has been stated by Ms. Afreen Bano that she wants to go with Mr. Sartaj to Hardoi. Accordingly, she is permitted to go for Hardoi with due protection of police so that no untoward incident happens to her during the course of her movement.
In case during the course of investigation, it is found necessary to record the statement under Section 164 CrPC, then that may be done and both the petitioners shall cooperate for the purpose.
So far as the argument advanced by the parties' counsel with regard to detention/stay at the police station voluntarily or involuntarily is concerned, we reserve the judgment.
