1. Heard Sri Vivek Mishra, learned counsel for the applicant and learned A.G.A for the State.
2. This application under Section 482 Cr.P.C. has been filed seeking direction to the court below for early decision of Sessions Trial No. 257 of 2013 (State Vs. Rajkumar), arising out of Case Crime No. 298 of 2012, under Sections- 376, 313, 392, 419, 420, 323, 504, 506 I.P.C., Police Station- Kaptan Ganj, District- Azamgarh, pending before the District Judge/F.T.C.-I, Azamgarh.
3. Learned counsel for the applicant submits that while the occurrence is of the yea 2012, the charge sheet was submitted and thereafter charges have also been framed on 04.09.2013. However, at present, the testimony of only one prosecution witness has been recorded and the matter has been unduly delayed. The applicant who is the complainant thus claims grave prejudice is being caused to her.
4. Without expressing any opinion on the merits of the case, this application is finally disposed of with a direction to the court below to decide the aforesaid case in accordance with law, as expeditiously as possible, without granting any unnecessary or long adjournments to either of the parties, preferably within a period of one year from the date of production of a certified copy of this order, if there is no other legal impediment.
