1. Heard learned Advocate Ms. Kruti Shah for the petitioner, learned APP Ms.Archana C. Raval for Respondent No.1-State of Gujarat and learned advocate Mr.Hardik Dave for respondent No.2-Original Complainant.
2. In view of the contentions raised with regard to vicarious liability of the petitioner, relying upon the judgment of Hon'ble Apex Court in case of National Small Industries Corporation Ltd. V. Harmeet Singh Paintal and another, reported in (2010) 3 SCC 330, the matter requires consideration.
3. Hence, Rule returnable on 27.08.2012. Learned A.P.P. Ms.Archana C. Raval waives service of notice of Rule for respondent No.1-State of Gujarat and learned Advocate Mr.Hardik Dave waives service of notice of Rule for Respondent No.2.
4. Ad-interim relief in terms of Para 7(C) qua the applicant till then.
