Heard learned counsel for the petitioners.
The present petition has been filed for a direction upon the Additional Civil Judge (Junior Division) Court No. 2, Ghaziabad to expedite the Original Suit No. 211 of 2011 (Jagdish Prasad Sharma Vs. Smt. Omwati and others) within a stipulated period.
The case of the petitioner is that respondent No. 3 has executed a sale deed in favour of respondent Nos. 1 & 2 though there have been no title over the land. For cancellation of the sale deed, the petitioners have preferred Suit No. 211 of 2011 which is still pending for decision even after seven years.
Considering the facts of the case, the petition is disposed of with a direction to the Court below to decide the suit expeditiously, preferably if possible within a period of one year from the date of production of certified copy of the order without granting any unnecessary adjournments to either of the parties.
