JUDGMENT / ORDER

Petitioner before this Court claims to be the tenant of the premises in question which has been declared vacant under orders of Respondent no. 2 dated 22.02.2010. The petitioner made an application for recall of the said order under Section 12 of the U.P. Act No. 13 of 1972. The application has been rejected by the Rent Control and Eviction Officer by means of the order dated 16.06.2010. The petitioner has, therefore, filed this writ petition with the allegation that against an order declaring the vacancy, no Revision under the U.P. Act No. 13 of 1972 is maintainable. It is not necessary for the Court to enter into the issues raised at this stage of the proceedings inasmuch as after allotment/release order is made which would be the cause for the petitioner to be evicted from the premises in question, he will be at liberty to challenge the order declaring the vacancy as well as the order allotting/releasing the premises. Writ petition is dismissed.
