Instant writ petition has been filed by the petitioner with the follow- ing prayers:-
"Issue a writ, order or direction in the nature of mandamus to di- rect the respondents to take appropriate and suitable action against the consolidation authorities of District-Baghat and re- stored the illegal allotments of chaks during consolidation pro- ceeding' of entire Village-Bamnauli, District-Baghpat to its original position prior to consolidation and the respondent authorities may also ensure the public utility land i.e. Nala, Chakroad, pits, roads, Naveen parti, ceiling land river land, forest land and custo- dian land situated in Village-Bamnauli, Tehsil-Baraut, Dis- trict-Baghpat in its original position and the illegal encroachment of the public utility land by the local musclemen with the help of district level Consolidation authorities and the irregularities were committed as a result whereof a huge chak of land were illegally encroachment as well as the allotment be removed in its original position and to take appropriate and legal action against the Gov- ernment Officials including the officials of Consolidation Depart- ment of district- Baghpat in pursuance of the detail reports sub- mitted by the three members committee constituted by the Con- solidation Commissioner, Lucknow and initiate the criminal pro- ceeding and take appropriate action against irresponsible in- volved officers of the Consolidation authority otherwise the public enlarge of the concerned village will suffer grave detriment and irreparable loss and injuries.”
In pursuance of the order dated 24.08.2021, learned Standing Coun- sel has produced instructions dated 10.08.2021 received from the office of the District Magistrate, Baghpat, which is taken on record.
For ready reference, order dated 24.08.2021 is quoted below:-
"It is submitted that public utility land in question of the village has illegally been granted in favour of influenced persons by the authority concerned. In this respect report dated 21.12.2017 has been filed by the committee concerned, but till date no action has been taken on the basis of the said report.
Learned Standing Counsel prays for and is granted time to seek instructions in the matter.
List this case as fresh on 24.08.2021."
It is submitted by learned Standing Counsel, on the basis of instruc- tion as received by him, that the report dated 21.12.2017 is with respect to the exchange value of the plots, which are being taken care of by the authority concerned. About 215 objections were received by Consolidation Officer, within a week and out of that 110 objections were decided. On the basis of the report, authority concerned has taken departmental proceed- ing against erring employs. All the disputes relates to the public utility land belongs to the gaon sabha have already been decided and recorded in the revenue record, as per the settlement.
It is further submitted that delivery of possession took place in vil- lage Bamnauli, and chak holder are in the possession of their respective chaks. There is no appose of consolidation proceeding in the village and the instruction issue by Consolidation Commissioner, on the basis of report dated 21.12.2017 submitted by the enquiry committee, have been fol- lowed.
