Heard learned counsel for the petitioners, learned A.G.A. for the State, Sri Yadavendra Dwivedi for the respondent no.4 and perused the record.
By means of the present petition, the petitioners are seeking quashing of the first information report dated 25.8.2021 registered as case crime no. 0277 of 2021, under sections 120-B and 366 I.P.C., police station Khaga District Fatehpur.
It is stated that the petitioner no. 1 and 2 have solemnized their marriage on 06.08.2021 in Arya Samaj Shiv Bihar Mandhana, Kanpur Nagar. The first information report has been lodged because the respondent / the complainant, the mother of the petitioner no. 1, is against their marriage.
It is stated by the learned counsel for the petitioners that the petitioner nos. 1 and 2 have applied an application on 24.8.2021 for registration of their marriage on-line. It is further submitted that the allegation in the first information report against the petitioners is false.
Considering the material on record and the averments in the first information report, we only provide that the petitioners shall not be arrested during the course of investigation. The Investigating Officer shall, however, be under obligation to conclude the investigation by following the strict procedure of law preferably within a period of three weeks from today.
The writ petition is accordingly, disposed of.
