This application is filed by the applicants for quashing the entire proceeding of charge-sheet No.60 of 2017 dated 18.08.2017 in Criminal Case No.13292/9 of 2017 in Pursuant to the F.I.R. dated 06.07.2017 arising out of Case Crime No.42 of 2017, under Sections 498-A, 323, 506 IPC and 3/4 Dowry Prohibition Act, P.S. Mahila Thana, District Muzaffarnagar, pending in the court of learned CJM, Muzaffarnagar as well as cognizance dated 20.09.2017 in pursuance of which court below passed summoning order as well as issue NBW on 28.06.2018 by the learned CJM, Muzaffarnagar.
After arguing at some length, learned counsel for applicants submits that grievance of applicant would be sufficiently met in case bail application of applicants is considered expeditiously in accordance with law.
In view thereof, it is provided that if the applicants surrender before the Court below within four weeks from today and applies for bail, the Court below will consider the same, in accordance with law in view of the observations made in the case of Lal Kamlendra Pratap Singh Vs. State of U.P. reported in [2009 (3) ADJ 322 (SC)].
For a period of four weeks, no coercive steps shall be taken against the applicants.
With the aforesaid, the application is disposed of.
