The simple prayer of the petitioners in the present writ petition is for expeditious disposal of Civil Appeal No.280 of 1998 which is pending before the Civil Judge (SC/ST Act), Allahabad.
It appears that suit for specific performance of an agreement to sell was filed and the same was dismissed on 6.10.1998. It is against the aforesaid judgment and order that the aforesaid appeal has been filed.
In view of the fact that the appeal is pending since 1998, without going into merits of the claim of the parties the writ petition is disposed of with the direction to the court concerned to proceed with the hearing of the appeal in accordance with law as expeditiously as possible and to decide the same within a period of 6 months from the date of production of the certified copy of this order provided there is no legal impediment in deciding the same.
