The contention of the learned counsel for the petitioner is that the allegations in the First Information relate to civil dispute between the parties i.e. purchaser and the seller of the land in question. The petitioner herein has no concern with the sale or purchase of the land. Allegations in the First Information Report that he took money from the first informant for mutation purposes is only a concocted story.
Looking to the allegations made in the first information report though this Court does not find any reason to quash the same, however, it is provided that the petitioner shall not be arrested in the Case Crime No.0172 of 2019 under sections 419, 420, 467, 468, 471, 506, 120-B of I.P.C. P.S.-Sakaldiha, District- Chandauli till the submission of the police report under section 173(2) Cr.P.C. He shall, however, cooperate in the investigation. No effort shall be made to influence the witnesses.
