This writ petition is filed for declaring the action of the respondents in attempting to forcibly dispossess them from their respective plot Nos 48, 50, 51, 54, 55, 56 and 57 covered by survey Nos 115, 118, 119, 121, 123, 136 and 138 of Yellapuvanipallem and Panchayath, H/o.Gopalapuram, Chinagadili Mandal, Visakhapatnam District which was allotted and sold to them by the OHP Employees Co-operative Building Society after getting lay out plan approved by the VUDA under L.P.No.34/89 as illegal and arbitrary.
Heard learned counsel for the petitioners and learned Standing Counsel for respondents.
The petitioners earlier filed W.P.No.22952 of 2006 against the District Collector and four others. In the said Writ Petition the present respondents are not parties and it was filed alleging interference and this Court disposed of the writ petition on the ground that the respondents denied the allegation of dispossession of the petitioners.
The learned Standing Counsel for respondents in the present case also submits that they are not dispossessing the petitioners as alleged in the writ petition and if any action is taken to dispossess the petitioners, they will follow due process of law.
Recording the said statement of learned Standing Counsel for the respondents, this Writ petition is disposed of directing the respondents to follow due process of law in the event of taking any action affecting the rights of the petitioners in respect of the property, which they are in possession.
In consequence, the miscellaneous petitions, if any, pending in this writ petition shall stand closed. No order as to costs.
