JUDGMENT / ORDER

Heard the learned counsel for the petitioner and the learned Government Pleader for respondents 1 and 2, apart from perusing the record. Since the issue lies in a narrow compass, this Court proposes to dispose of the writ petition at the admission stage itself. 2. Briefly stated, the petitioner was appointed on 2/6/2008 through Ext.P1 as UPSA in the school under the management of the 3rd respondent. Though, initially, the petitioner was appointed on daily wage basis, in the light of the judgment rendered by this Court in W.P.(C)No.29731 of 2007, proceedings were issued appointing the petitioner on regular basis from the initial date of appointment. The grievance of the petitioner is that presently, through Ext.P5 staff fixation order for the academic year 2014-2015, despite clear vacancies, the petitioner was retrenched and assigned to the W.P.(c).No.25159 of 2014 : 2 :
Teachers' Bank. Aggrieved thereby, the petitioner filed Ext.P6 statutory revision which is yet to be disposed of by the 1st respondent. Under those circumstances, the petitioner approached this Court.
3. The learned Government Pleader, on his part, has submitted that since the issue has actively been seized of by the 1st respondent, it does not call for any adjudication on merits at this junction.
4. Having regard to the respective submissions of the learned counsel for the petitioner and the learned Government Pleader, without expressing any opinion on the merits of the matter, this Court disposes of the writ petition with a direction to the 1st respondent to consider Ext.P6 statutory revision filed by the petitioner, after duly providing any opportunity of personal hearing to the petitioner, and pass appropriate orders thereon, as expeditiously as possible, at any rate, within two months from the date of receipt of a copy of this judgment. It is made clear that if the petitioner is being continued as UPSA in the 3rd respondent's school, she shall not be destructed until Ext.P6 W.P.(c).No.25159 of 2014 : 3 :
revision is disposed of. If required, the petitioner shall produce a copy of the writ petition along with a copy of this judgment before the 1st respondent. No order as to costs.
