JUDGMENT / ORDER

The petitioner, who is a candidate included in Ext.P1 ranked list for the post of Assistant Professor in Electronics and Instrumentation in the engineering colleges run by the Co-operative Academy of Professional Education at Kidangoor and Vadakara, has filed this writ petition for a writ in the nature of mandamus commanding respondents 1, 4 and 5 to appoint her as Assistant Professor in one of the vacancies of Assistant Professor. The petitioner has also prayed for a writ in the nature of mandamus commanding the first respondent to fill up all the available vacancies in the colleges under it from Ext.P1 ranked list strictly in accordance with the directions issued by the All India Council for Technical Education. 2. The validity of Ext.P1 ranked list will expire on 10.6.2014.
Even on going by the stand of the petitioner, rank Nos.1, 2 and 3 therein have been appointed. The instant writ petition was filed on 4.6.2014 and it was preceded by Ext.P3 letter dated 21.3.2014 sent by the petitioner to the first respondent wherein she had requested that she may be appointed as Assistant Professor in one of the W.P.(C) No.14251/2014 2 vacancies available either at Kidangoor or Vadakara or in any other college under the first respondent. In that representation she contended that the number of Assistant Professor ought to have been 22 instead of 14 (9 Assistant Professors at Kidangoor and 5 at Vadakara) and that it amounts to violation of the norms of the All India Council for Technical Education. It is on these grounds that the petitioner prays for an order directing the respondents to appoint her as Assistant Professor .

When the writ petition came up for hearing today, Sri.V.Krishna Menon, learned standing counsel appearing for the Corporative Academy of Professional Education submitted on instructions that the staff strength of Assistant Professors in the department of Electronics and Instrumentation in the two engineering colleges at Kidangoor and Vadakara is 12 (6 in each college), that all the vacancies have been filled up and at present there is no vacancy against which the petitioner can be appointed. The learned standing counsel also submitted that no Assistant Professor appointed on ad hoc basis is in service, that the ranked list will expire on 10.6.2014 and that over the past few years the number of students seeking admission for the B.Tech degree course in Electronics and Instrumentation Engineering in the colleges run by the Co-operate Academy of W.P.(C) No.14251/2014 3 Professional Education is diminishing.

The petitioner cannot merely for the reason that her name is included in the ranked list contend that notwithstanding the fact that the number of students seeking admission for the particular course is decreasing every year, the management of the college should adopt the norms of the All India Council for Technical Education and increase the number of teachers in the faculty of Electronics and Instrumentation Engineering. The petitioner does not dispute the fact that all the existing vacancies of Assistant Professors have been filled up. Further, the ranked list will cease to be in force on 10.6.2014.
In such circumstances, I am of the opinion that the reliefs prayed for by the petitioner cannot be granted. The writ petition fails and is accordingly dismissed.
